Opening or Not Opening an Estate

This letter is being written so that someone else may not have to go through what we have since the passing of our Mother.

This is not something anyone likes to talk about in advance but it may save you some time and money at a time when you are still grieving for the loss of a loved one and have to make decisions. In my opinion it would be advisable to check with a couple of different attorneys to see if an estate needs to be opened or not. We did, after the fact, and would not have had to open an estate. The attorney handling our Mother's reading of the will, opened the estate, which is not against the law, but after checking with two other attorneys, we were told it would not have needed to be done and they both would have advised us of this. I am better informed now and wish I had been when we were asked to sign papers after the reading of the will. It is not even the percent of monies that the attorney received, but the simple fact that our options were not explained to us by the attorney at a time when we were vulnerable. Situations are always a little different but this may save you or your children some time, money and grief in the future.
